Terms & Conditions

Peace of Mind Nursery, Inc. Mission Statement: We are committed to offer the highest quality of healthy and unique conifers and ornamentals with competitive pricing.

Visitors Welcome: We are pleased to give tours of our plant material rain or shine. Our normal business hours are Tuesday through Saturday 9:00 am - 4:00 pm.

Terms: Cash. Credit requires 25% deposit with order, balance due prior to shipment. For established customers payment is due Net 30 from the date of invoice. Past due balances after 30 days accrue 1.5% per month (18% annually). If the Purchaser fails to timely pay the Seller the amount due, then the Seller shall be entitled to recover all expenses of collection costs, (including Collection Agency costs and fees, which shall be in an amount no less than 25% of the unpaid principle balance) and attorney fees incurred to enforce the terms of this agreement, whether or not suit is filed, including such costs as may be incurred in bankruptcy fees as may be awarded in arbitration by a court at trial or on appeal. Translation: If Purchaser pays on time there is not a problem. Single plant purchases: add 20%. * Prices subject to change without notice. Specimen plants may be priced individually. Cost of shipping is not included in graft pricing. There is no minimum purchase requirement.

Claims: Claims must be made within 5 days of receipt and must be documented on the Bill of Lading at time of delivery. Photographs must accompany claim. NO claim will be accepted in excess of original sale price.

Freight: Due to fluctuating transportation rates, we request shipping arrangements be made by customer. Contacts available upon request.

Shipping: Nursery stock orders travel at the risk and cost of the buyer. Seller’s responsibility terminates on delivery to the carrier. Understanding that plant size is ever changing, we reserve the right to substitute one size larger or smaller than requested without notifying purchaser. Plants are sold FOB West Linn, Oregon.

Warranty: We give no warranty, express or implied, as to life, quality, productiveness, or any other matter of any nursery stock we sell. It is mutually agreed that our total liability for any error, should stock prove to be untrue to name as labeled, shall be limited to no more than the purchase price of the plants. We seek to please our customers by providing healthy plants of the highest quality; however, we cannot be held responsible for crop failure or other conditions beyond our control. This nursery is regularly inspected and certified to be free of insect pests by the Oregon State Department of Agriculture.
